A Los Angeles based gay porn star went on a workplace rampage that has claimed the life of one person and wounded two others. The victims are all presumed to be the co-workers. The actor, Steven Hill, was recently fired by his employer, Ultima Entertainment, an event that apparently triggered a violent reaction. After the attack, the porn star fled the premises in a Toyota RAV4 SUV and is now the object of a police pursuit.

After killing one person, two employees at the company were wounded in a failed attempt to accost Hill. The murder weapon is said to be a samurai sword the company had on hand as a prop. Media sources that when not performing in pornographic features, Hill worked as a production worker for other movies. Because Hill lost his job and his residence at the same time, early indications suggest that Hill snapped under the pressure. Reports appear to confirm that Ultima operated a film studio and distribution operation at the scene of the attack, although the fact that Hill actually lived on the scene has not been verified. Hill is reportedly a six foot tall African American man who has been struggling to develop a full-fledged pornographic actor career.

The Los Angeles Police Department is said to be handling the investigation as well as a manhunt that appears to be widening in its scope. The police have yet to officially release the name of the dead victim who apparently passed away during efforts to treat a major wound to the torso. The nature of the wounds suffered by the other two victims has not been released as well as their names.

Media reporters have attempted to contact the principles of the Ultima company for comment, but so far they have not been reached for comment. Internet sites seem to portray Ultima as a small porn outlet that specializes in fetishes and the female domination of males.

James O’Keefe, who posed as a pimp for undercover sting videos that badly damaged the credibility of ACORN, has been arrested for apparently trying to pull a sting on the office of Sen. Mary Landrieu (D-La.).

FBI Special Agent Steven Rayes alleges that O’Keefe aided and abbetted two others, Joseph Basel and Robert Flanagan, who dressed up as employees of a telephone company and attempted to interfere with the office’s telephone system.

A fourth person, Stan Dai, was accused of aiding and abetting Basel and Flanagan. All four were charged with entering federal property under false pretenses with the intent of committing a felony.

O’Keefe had become a conservative media star since the ACORN sting. I just talked to Lisa De Pasquale, director of CPAC, who said that O’Keefe, along with co-stinger Hannah Giles and Andrew Breitbart, is (or was) under consideration for the annual conservative conference’s coveted Reagan Award.

Mike Flynn, the editor of Big Government–where the ACORN videos originally appeared–told me that the conservative news site had no knowledge of what O’Keefe was up to.

“We had absolutely no clue what he was up to,” said Flynn, “and now you see why! It’s a complete surprise to us. We’ll just see what happens.”

UPDATE: The FBI’s press release on the case:

Four Men Arrested for Entering Government Property Under False Pretenses for the Purpose of Committing a Felony

NEW ORLEANS—JOSEPH BASEL, age 24; ROBERT FLANAGAN, age 24; JAMES O’KEEFE, age 25; and STAN DAI, age 24, were charged in a criminal complaint with entering federal property under false pretenses for the purpose of committing a felony, announced the United States Attorney’s Office for the Eastern District of Louisiana.

According to the complaint, which was unsealed earlier today, the arrest of FLANAGAN, BASEL, O’KEEFE, and DAI took place after BASEL and O’KEEFE attempted to gain access to the New Orleans office of United States Senator Mary Landrieu on January 25, 2010, while posing as telephone repairmen. According to the complaint, FLANAGAN and BASEL were each dressed in blue denim pants, blue work shirts, light green fluorescent vests, tool belts, and construction-style hard hats when they entered the Hale Boggs Federal Building, located at 500 Poydras Street, New Orleans, Louisiana 70130. Once in the building, FLANAGAN and BASEL sought access to the offices of Senator Landrieu. O’KEEFE was already present in the office, holding a cellular phone so as to record FLANAGAN and BASEL. Once inside Senator Landrieu’s reception area, FLANAGAN and BASEL told a member of Senator Landrieu’s staff that they were telephone repairmen, and they requested access to the main telephone at the reception desk. FLANAGAN and BASEL then manipulated the telephone system. FLANAGAN and BASEL next requested access to the telephone closet because they needed to perform work on the main telephone system. They were directed to the main office of the United States General Services Administration, also inside the Hale Boggs Federal Building, where they again represented themselves to be employees of the telephone company and stated that they needed to perform repair work in the telephone closet. Both FLANAGAN and BASEL stated that they had left their credentials in their vehicle. In addition, the complaint alleges that O’KEEFE and DAI assisted FLANAGAN and BASEL in the planning, coordination, and preparation of the operation. The men were apprehended by the United States Marshal’s Service soon thereafter.

If convicted, FLANAGAN, BASEL, O’KEEFE, and DAI each face a maximum term of 10 years in prison, a fine of $250,000, and three (3) years of supervised release following any term of imprisonment.

The United States Attorney’s Office reiterated that the complaint is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

The investigation is being conducted by Special Agents of the Federal Bureau of Investigation and Deputy Marshals with the United States Marshal’s Service. The case is being prosecuted by Assistant United States Attorney Jordan Ginsberg.

Tefillin is a harmless — but uncomfortable — set of boxes (containing prayers) and straps that some Orthodox Jewish men wear as a demonstration of faith. After the plane was searched and declared clear, the teen and his sister were labeled “disruptive” and taken for questioning. Gothamist raises an excellent question after this story: Will this change outspoken Jewish Assemblyman Dov Hikind’s position on using ethnic profiling in airport security?

It is also the same type of explosive that terrorists like the Shoe-Bomber attempted to use, and the same one that the infamous Christmas flight bomber failed to use on his flight to Detroit.

What is so appealing about this explosive to terrorists is that it is very small, yet powerful for its size, it’s also undetectable by metal detectors, and it can be hidden on the body. Even with the Millimeter Wave Screening scanner (a new scanner used in some airports that takes an X-Ray like picture of the body), the bombs were not detected.

This experience shows us that the government and airports have to step up their security and find a new way to screen passengers for these types of explosives. Or at the very least, start using more of the methods of screening passengers to prevent terrorists from sneaking explosives onto the planes.

West Memphis 3 is the name given to the three teen killers of three 8-year-old Cub Scouts back in 1993. The West Memphis 3 – Damien Echols, Jason Baldwin and Jessie Misskelley – have been serving their sentences after they have been convicted of the killing. MissKkelley and Baldwin had life sentences and Echols was on death row.

Now, David Mitchell, writing in the Arkansas Law Review, said that a new evidence in the West Memphis Three murder case.

A news release:

The Arkansas Law Review, a publication of the University of Arkansas School of Law in cooperation with the Arkansas Bar Association, has published a lengthy and scholarly article reviewing the legal issues surrounding the innocence claims of Damien Echols,Jason Baldwin and Jessie Misskelley.

New evidence in the case revealed that while no DNA of the convicted young men was found at the crime scene, DNA from Terry Hobbs, stepfather of Stevie Branch, was found in the ligature binding the hands and feet of one of the other children. In addition, some of the country’s leading forensic pathologists have concluded that most of the wounds found on the bodies were, in fact, the result of post mortem animal bites, and not knife wounds, a belief upon which the prosecution based its case.

The well-researched article by David S. Mitchell, Jr., Lock ’Em Up and Throw Away the Key: The “West Memphis Three” and Arkansas’s Statute for Post-Conviction Relief Based on New Scientific Evidence (Volume 62, number 3), reviews the decision by Craighead County Circuit Judge David Burnett, who denied the West Memphis 3’s request for a new trial based upon new DNA and other evidence. In September 2008, Judge Burnett summarily denied Echols’s, Baldwin’s and Misskelley’s respective motions without granting a hearing.

According to the Law Review article, the circuit court employed a very narrow interpretation of the post-conviction relief (DNA) statute (section 16-112-208-(b) (e) to deny Damien Echols and theWest Memphis 3 a new trial.

“A close examination of the legal and factual issues presented by Echols’s motion for a new trial reveals the circuit court’s failures on each level, particularly the way the circuit court’s interpretation of the statute eviscerated its purpose.”

“After evaluating the legal arguments presented by the State and Echols on each of these issues, this comment reaches the conclusion that the trial court erred in denying Echols’s motion for a new trial.”

Echols’s case meets the standards set forth in the Arkansas statute as well as the intention of the legislature when the statute was passed in 2001. “The court may then grant a motion for a new trial or resentencing if the DNA test results, when considered with all evidence in the case regardless of whether the evidence was introduced at trial, would establish by compelling evidence that a new trial would result in acquittal. The new evidence is sufficient to establish that any reasonable juror would have reasonable doubt as to Echols’s guilt…”

He concluded, “the circuit court failed in its interpretation of Arkansas’s post-conviction relief statute…it also failed to meet the Arkansas Legislature’s goal of accounting for the ability of new technology to accomplish the mission of criminal law –to punish the guilty and exonerate the innocent.”

The circuit court reasoned that the legislative history of the statute indicated Echols’s testing results were “inconclusive” and required that the motion be denied under section 208 (b). Accordingly, the court gave great significance to the fact that the DNA testing was ordered under a prior version of the statute that allowed that DNA tests could be conducted when the evidence had the “scientific potential” to be materially relevant to the claim of relief. The 2005 statute had a stricter standard that allows only for testing when the results could raise a reasonable probability that the person did not commit the offense. In either interpretation of the statute, Echols, Baldwin and Misskelley meet the standards for a new trial.

The legal community, nationally as well as in Arkansas, has emerged as an important ally in the effort to obtain a new trial for Damien Echols,Jason Baldwin and Jessie Misskelley. The Arkansas Law Review article comes on the heels of the support of the National Association of Criminal Defense Lawyers and the Northwestern University School of Law’s Center on Wrongful Convictions, who jointly submitted an Amicus Brief to the Arkansas Supreme Court on behalf of Echols’s appeal for a new trial.

Holder will also announce that five other detainees will be sent to military commissions for trial, said the official, who did not want to be named.

Holder has set a news conference for 11 a.m. to announce the decisions.

Mohammed “will be subject to the most exacting demands of justice,” President Obama said Friday in Japan.

“The American people insist on it, and my administration will insist on it,” Obama told reporters at a joint news conference with Japanese Prime Minister Yukio Hatoyama.

Mohammed is the confessed organizer of the September 11, 2001, attacks on New York and the Pentagon. But his confession could be called into question during trial. A 2005 Justice Department memo — released by the Obama administration — revealed he had been waterboarded 183 times in March 2003.

Obama has called the technique, which simulates drowning, torture.

Mohammed is one of five defendants in the 9/11 attacks being held at the U.S. military detention center in Guantanamo Bay, Cuba. The other four are Ramsi Binalshibh, Walid Muhammed bin Attash, Ali Aziz Abdul Ali and Mustafa Ahmed al-Hawsawi.

National Public Radio, citing “officials familiar with the situation,” said all five defendants will be tried in the U.S. District Court for the Southern District of New York, a short distance from where the twin World Trade Center towers once stood.

As officers led a handcuffed Jason Rodriguez at a police station, a reporter asked the 40-year-old divorced, for attacking his former colleagues.

“Because I left the putrefaction” said Rodriguez, who recently told a bankruptcy judge for less than $ 30,000 a year at a Subway sandwich shop and had about $ 90,000.

The shooting on the eighth floor of an office tower in downtown Orlando paralyzed for three hours. Police quickly tracked Rodriguez to his mother’s house, saw him through a window and ordered him out.

He surrendered peacefully and was arrested on Friday night. Police said he apologized as agents handcuffed him.

“I am going through a difficult time right now. I’m sorry,” the official was quoted as saying.

Police say he will be charged with first degree murder and other crimes. Authorities said they could make an initial court appearance Saturday.

All the victims worked at the firm of Reynolds, Smith and Hills, where Rodriguez was an entry level engineer for 11 months before he was fired in June 2007, the company said.
